PRIVACY AND GENERAL TERMS OF USE

The PANTHER FREIOS online store is an e-commerce platform where users purchase payment and shipping solutions.

Melhor Envio is the technological tool we offer so that users can send and receive purchases made on websites or applications that use PANTHER FREIOS technology.

To operate on the platform, all users must accept the Terms and Conditions, the annexes, and the Privacy Statement.

Each user is responsible for the personal data provided at the time of registration and agrees to keep it updated. Furthermore, the user is solely responsible for the use and protection of their password.

General Terms and Conditions of Use of the Website

PANTHER FREIOS is a technology company that offers products mainly related to e-commerce and digital payments.

 

02- Terms and Conditions

These terms and conditions govern the relationship between PANTHER FREIOS and the people who use its services.

Users accept these Terms and Conditions from the moment they register on the Site.

When we need to make significant changes to our services, we will publish the modifications 10 calendar days in advance so that users can review them and continue using the platform. Under no circumstances will these changes affect operations that have already been completed.

 

03- Capacity

Only adults with the legal capacity to contract may use our services.

Those using PANTHER FREIOS on behalf of a company must have the capacity to contract on its behalf. Furthermore, to use the account, the user must be active.

 

04- Registration and Account

Those wishing to use our services must complete the registration form with the required information. By completing it, the user agrees to provide accurate, precise, and truthful information and to keep their data always updated. The user will be solely responsible for the accuracy of the registration data. Without prejudice to the information provided in the form, we may request and/or consult additional information to verify the user's identity.

The account is personal, unique, and non-transferable; that is, under no circumstances may it be sold or transferred to another person. The account is accessed with the chosen personal security password and must be kept strictly confidential. The User may create Collaborator Accounts and define access permissions. In any case, the user will always be solely responsible for the operations performed on their account. If the user identifies unauthorized use of their account, they must immediately notify PANTHER FREIOS.

We may reject a registration request or cancel a registration already accepted, without this generating any right to compensation. Users who have been previously deactivated will not be able to register again on the site. Those who are included in or related to people appearing on national or international sanctions lists will also not be able to register.

 

5. Data Privacy

At PANTHER FREIOS, we use personal information responsibly, protecting the privacy of users who have entrusted us with their data and taking the necessary measures to guarantee its security.

 

6. Sanctions

If a user violates a law or the Terms and Conditions, we may warn, suspend, restrict, or temporarily or permanently deactivate their account, without prejudice to other sanctions established in the specific rules of use of PANTHER FREIOS services.

 

7. Liability

PANTHER FREIOS will be liable for any defect in the provision of its service, to the extent attributable to it and within the scope provided for in current laws.

8. Intellectual Property

 

PANTHER FREIOS owns all intellectual property rights to its websites, all its content, services, products, trademarks, trade names, logos, designs, images, advertising slogans, copyrights, domains, computer programs, codes, developments, software, databases, information, technology, patents and utility models, industrial designs and models, trade secrets, among others (hereinafter referred to as the “Intellectual Property”), which are protected by national and international laws.

Although PANTHER FREIOS grants permission to use its products and services as provided in the Terms and Conditions, this does not imply authorization to use its Intellectual Property, except with the prior and express consent of PANTHER FREIOS. In any case, users who sell these products and services may not use PANTHER FREIOS' Intellectual Property in a way that causes confusion among the public, and must conduct their commercial activity under their own distinctive brand or trade name that is not confusingly similar to the PANTHER FREIOS brand.

It is prohibited to use our products or services for illegal purposes, to perform any type of reverse engineering or derivative works, to use search tools or data extraction and content from our platform for reuse and/or to create their own databases that include, in whole or in part, our content without our express authorization. It is also prohibited to misuse, without authorization and/or contrary to current regulations and/or that generates confusion or implies defamatory use and/or that causes harm, damage or losses to PANTHER FREIOS. The use of PANTHER FREIOS' products and services also does not imply authorization to use the intellectual property of third parties that may be involved, the use of which will be the sole responsibility of the user.

 

9- Indemnity

The user shall hold PANTHER FREIOS and its related companies, as well as those who direct, succeed, administer, represent and/or work for them, harmless from any administrative or judicial claim initiated by other users, third parties or any entity, in relation to their activities at PANTHER FREIOS.

By virtue of this liability, they may take compensation, withholdings or other measures necessary for the reparation of losses, damages and harm, whatever their nature.

 

10- Jurisdiction and Applicable Law

These Terms and Conditions are governed by local law. Any controversy arising from their application, interpretation, execution or validity shall be resolved by the competent ordinary national courts located in the capital, unless otherwise specified by public policy regulations, such as consumer protection legislation.

WARRANTY AND TECHNICAL ASSISTANCE POLICY

1) Warranty: The warranty period for factory defects in the device and test cables is 1 year from the date of receipt. This period becomes void if the product is damaged due to misuse or improper storage.

During the warranty period, all shipping costs are our full responsibility.

2) Technical Assistance: After contacting technical support, if it is necessary to send the equipment for maintenance, the customer will receive instructions via email and/or WhatsApp. The service order will be issued within 2 business days of receiving the product. If the product is under warranty, the customer will not incur any costs for shipping, replacement parts, or labor. For products outside of warranty, budget approval will be required. In both cases, the maximum time for resending the merchandise is 30 days after receipt.

EXCHANGE, RETURN AND REFUNDS

Refunds, guaranteed by law through the Consumer Code, occur in the following situations:
1. Right of withdrawal.
According to Article 49, sole paragraph, of the Consumer Protection Code, the customer may withdraw from the purchase contract within 7 business days after receiving the merchandise.
2. Product unfit for consumption
Article 18 of the Consumer Protection Code ensures a refund in the case of quality or quantity defects that make consumer products (durable or non-durable) the responsibility of the supplier.
The consumer may demand the replacement of the defective parts, and if the defect is not remedied within a maximum period of thirty days, the customer may demand, at their choice:
a) that the product be replaced by another, in perfect condition for use (in accordance with Article 18, § 1, I of the Consumer Protection Code);
b) that the amount paid be refunded immediately, updated, and without prejudice to any losses and damages (Article 18, §1, II of the Consumer Protection Code);
c) the proportional reduction of the price (Article 18, §1, III of the Consumer Protection Code)
3. Defective Product
In this case, the same conditions as in item 02 are ensured. The exceptions are provided for in Article 14, §3, items I and II of the Consumer Protection Code: when the company confirms that the defect does not exist or that it was the exclusive fault of the consumer/third party.
In all cases, the customer must follow the instructions of the technical support after the initial contact. In case of returns, for the safety of both parties, PANTHER FREIOS will film the moment it opens the box, to avoid subsequent misunderstandings. If the product is in its original condition, the customer will be instructed on how to issue the return invoice, and the refund will be processed within 24 hours of the invoice being issued.
The refund will be made using the payment method selected at the time of purchase. For refunds to credit cards, the timeframe for the credit to appear on your statement is determined by the card company.

NATIONAL AND INTERNATIONAL SHIPPING

The shipping time is up to 15 business days after order confirmation, if we do not have the product in stock. This time corresponds to the production period.
For domestic shipments, we use the Melhor Envio and Enviali platforms, always opting for the best cost-benefit option among Correios, Jadlog, or Latam Cargo.
For international shipments, the customer must select the "INTERNATIONAL TO BE AGREED UPON" option and inform our team by email and/or WhatsApp which company should be contracted (Fedex, DHL, Correios, etc.). The customer is responsible for paying the shipping directly to the company if they choose to contract directly or pass the amount on to Panther Freios when it is responsible for contracting the services.
